Marketing Compliance: GDPR, CCPA, and Privacy Regulations

Privacy regulations have fundamentally changed how marketers collect, store, and use customer data. Non-compliance creates legal risk, financial penalties, and reputational damage that can be severe.
GDPR basics: the General Data Protection Regulation applies to any business that processes personal data of EU residents, regardless of where the business is located. It requires explicit consent for data collection, the right to access and delete personal data, data breach notification within 72 hours, and data protection by design.
CCPA and CPRA basics: the California Consumer Privacy Act and its amendment give California residents the right to know what data is collected, the right to delete their data, the right to opt out of data sales, and protection against discrimination for exercising privacy rights.
Consent management: implement a consent management platform (CMP) on your website. Before dropping cookies or tracking users, obtain explicit consent. Consent must be freely given, specific, informed, and unambiguous. Pre-checked boxes do not constitute valid consent under GDPR.
Email marketing compliance: GDPR requires explicit opt-in for marketing emails. CAN-SPAM (US) requires an unsubscribe mechanism and honest subject lines. CASL (Canada) requires express consent. Maintain records of when and how each subscriber consented.
Data minimization: collect only the data you actually need for your stated purpose. Every additional data point increases your compliance burden and breach risk. Ask yourself: do we need this field, and can we justify collecting it?
Third-party data: if you share data with ad platforms, analytics tools, or marketing vendors, you need data processing agreements with each. You are responsible for how your vendors handle data you share with them.
Cookie policies: maintain an accurate, up-to-date cookie policy that lists every cookie your site uses, its purpose, and its expiration. Categorize cookies (necessary, analytics, marketing) and allow users to choose which categories they accept.
Privacy by design: build privacy considerations into marketing systems from the start rather than retrofitting compliance. This means default privacy settings, minimal data collection, secure storage, and clear data retention policies.
