Influencer Contract Essentials: What to Include in Collaboration Agreements
Essential elements of influencer collaboration contracts: deliverables, timeline, content rights, compensation, FTC compliance, and exclusivity.
Influencer contracts protect both parties and set clear expectations. Without a written agreement, misunderstandings about deliverables, timing, and rights are common and costly.
Deliverables must be specific. Number of posts, format (feed post, Story, Reel, video), platform, caption requirements, and hashtag or disclosure requirements. Do not leave deliverables vague — one Instagram post could mean a carousel, a single image, or a Reel depending on interpretation.
Timeline and scheduling: specify posting dates or windows. Include draft review deadlines — typically the brand reviews content 48-72 hours before posting. Include revision allowances (usually 1-2 rounds).
Content rights and usage: specify who owns the content, how long the brand can use it, and in what contexts. Can the brand repurpose the content for ads? For how long? Across which platforms? Usage rights directly affect compensation.
Compensation terms: fixed fee, performance-based, product only, or hybrid. Specify payment timeline — typically 50 percent upfront and 50 percent upon completion, or net-30 after deliverables are approved.
FTC compliance: include requirements for proper disclosure (ad, sponsored, or paid partnership tags). Both the brand and the influencer are liable for non-disclosure. Make compliance a contractual obligation.
Exclusivity clauses: if the influencer cannot promote competing products, specify the exclusivity period, product category, and any additional compensation for the restriction.
Cancellation and dispute terms: define what happens if either party needs to cancel, content underperforms, or disputes arise. Clear terms prevent costly disagreements.
